Agreement to Terms

These Terms and Conditions govern your use of the Water Gone Restoration website at watergonerestoration.com and your engagement of our restoration services. By accessing our website or contracting with us for services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.

Water Gone Restoration is a licensed restoration contractor operating in Orange County, California. Our principal place of business is 23 Cortona, Irvine, CA 92614.

Services

Water Gone Restoration provides emergency and non-emergency property restoration services including water damage restoration, flood cleanup, fire and smoke damage restoration, structural drying, mold remediation, and related reconstruction services (collectively, "Services") to residential and commercial property owners in Orange County, California.

All Services are performed in accordance with applicable IICRC standards (including S500 and S700), California contractor licensing requirements, and OSHA workplace safety regulations. Specific scope, timeline, and pricing for any project are governed by the separate written service agreement or work authorization you sign prior to commencement of work.

Estimates and Pricing

Free estimates are provided without obligation. Any estimate provided — whether verbally, in writing, or through our website — is an approximation based on information available at the time of assessment. Final pricing may differ from estimates as hidden damage is uncovered during the restoration process.

All pricing for insurance-covered work is documented in accordance with industry-standard estimating practices and submitted directly to your insurance carrier. For work not covered by insurance, final pricing will be confirmed in writing before work begins.

Insurance Claims and Billing

Water Gone Restoration regularly works directly with insurance carriers on behalf of our clients. When you engage us for insurance-covered work and authorize us in writing to communicate with your insurer, we will:
1. Document the scope of loss and submit it to your carrier
2. Communicate directly with your assigned adjusterBill your insurance company directly for covered work

You remain responsible for your policy deductible and any costs that fall outside your policy's coverage. Water Gone Restoration makes no guarantee regarding the outcome of any insurance claim, as claim approval is solely at the discretion of your insurance carrier. We will advocate on your behalf using thorough documentation, but we cannot guarantee specific coverage amounts or claim approval.

If your carrier disputes any portion of the claim, we will make reasonable efforts to support an appeal, but we are not liable for any shortfall between our invoice and your insurance settlement.

Client Responsibilities

To enable us to perform Services effectively and safely, you agree to:
1. Provide accurate information about your property and the nature of the damage
2. Ensure we have safe and timely access to the affected areas of your property
3. Notify us promptly of any changes to your insurance coverage or adjuster assignment
3. Obtain any required HOA, landlord, or third-party approvals before work begins if applicable
4. Not interfere with drying equipment, containment barriers, or restoration materials placed on site

Delays caused by your failure to provide access or required approvals may result in extended timelines and additional costs, for which Water Gone Restoration is not responsible.

Scope Changes and Supplemental Work

Restoration work often reveals damage not visible during initial assessment. If additional damage is discovered during the course of a project, we will notify you and your insurance carrier and submit a supplemental claim or change order as appropriate. Work will not expand materially beyond the original agreed scope without your written authorization, except in emergency situations where immediate action is required to prevent further property damage.

Warranties

Water Gone Restoration warrants that all restoration work will be performed in a professional and workmanlike manner consistent with applicable IICRC standards. We warrant our labor and materials against defects for a period of one year from the date of project completion, subject to the following conditions:
1. The warranty applies only to work directly performed by Water Gone Restoration
2. The warranty is void if the property sustains new water intrusion, fire, or other damage after project completion
3. The warranty does not cover pre-existing conditions, cosmetic variations in materials, or damage caused by third parties

This warranty is your exclusive remedy for defective workmanship. All other warranties, express or implied, are disclaimed to the fullest extent permitted by California law.

Limitation of Liability

To the fullest extent permitted by applicable law, Water Gone Restoration's total liability to you for any claims arising out of or related to our Services shall not exceed the total amount paid by you (or your insurer on your behalf) for the specific Services giving rise to the claim.

In no event shall Water Gone Restoration be liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of revenue, or damage to personal property not directly caused by our work, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under California law.

Mold and Environmental Conditions

Water Gone Restoration applies EPA-registered antimicrobial treatments and follows IICRC protocols to prevent mold growth during the restoration process. However, we cannot guarantee that mold will not develop after project completion if new moisture is introduced to the property. If mold is discovered during restoration that was not part of the original scope, we will notify you and address it under a separate work authorization.

Pre-existing mold, environmental hazards, asbestos, or lead paint discovered during restoration work will be disclosed to you immediately. Remediation of such conditions may require separate licensed specialists and is outside the standard scope of restoration services unless specifically included in your written work authorization.

Intellectual Property

All content on the watergonerestoration.com website — including text, images, logos, and design — is owned by or licensed to Water Gone Restoration and protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.

Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of others. You may not attempt to gain unauthorized access to any portion of our website or its underlying systems. We reserve the right to suspend or terminate access to the website for any user who violates these terms.

Our website content is provided for general informational purposes only and does not constitute professional advice. Emergency restoration decisions should always be made in consultation with a qualified restoration professional.

Any dispute arising out of or related to these Terms or our Services shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in Orange County, California under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
You waive any right to bring claims as a class action or in a representative capacity.

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or Services after any changes constitutes acceptance of the revised Terms.
